     GENERAL PROVISIONS

    • The terms of this online store (hereinafter - the Terms) are a legally binding document for the Buyer and the Seller (hereinafter - the Seller), which sets out the rights and obligations of the Parties.
    • The Seller reserves the right to change, amend or supplement these Terms at any time.
    • The Buyer is informed about changes in the Terms on the online store's website.

    CONCLUSION OF PURCHASE-SALE AGREEMENT

    • The purchase-sale agreement between the Buyer and the Seller is concluded when the Buyer creates and submits an order for goods in the online store, having previously familiarized himself with these terms.

    SELLER‘S RIGHTS

    • In the event of essential circumstances, the Seller may entirely or temporarily suspend the operation of the online store without notifying the Buyer in advance.
    • Suppose the Buyer tries to harm the operation of the online store, its stability and security or violates his obligations. In that case, the Seller can stop him from using the online store without warning.

    OBLIGATIONS OF THE SELLER

    • The Seller undertakes to make it possible to use the services of the online store www.flameolingerie.com, the operating conditions of which are determined by these Terms.
    • The Seller undertakes to deliver the goods purchased by the Buyer by the chosen delivery method, based on the conditions set by these Purchase-Sale Terms.
    • When, due to unforeseen circumstances, the Seller cannot deliver the goods ordered in the online store, the Seller has the right to terminate the Purchase-Sale Agreement after notifying the buyer beforehand. The Seller can offer an analogical product. If the Buyer refuses, the Seller undertakes to return the money paid within 14 business days.
    • After the Buyer exercises the right to return the goods, the Seller undertakes to return the money paid to the Buyer within 14 (fourteen) calendar days from the day of receipt of the returned goods.
    • The Seller may not refund the amount paid to the Buyer until the goods are returned to the Seller or until the Buyer provides proof that the goods have been sent to the Seller, whichever occurs first.

    BUYER'S RIGHTS

    • The Buyer can buy goods in the online store following these Terms.
    • The Buyer has the right to refuse the agreement of purchase – sale of goods concluded in the online store by notifying the Seller in written form no later than 14 (fourteen) calendar days from the day of delivery of goods.
    • The Buyer can exercise the right to return the goods only if they have not been damaged or their appearance has not fundamentally changed and if they have not been used.

    OBLIGATIONS OF THE BUYER

    • The Buyer must pay for the purchased goods and accept them following the procedure provided for in these Terms.
    • If the Buyer refuses to accept the goods without a valid reason during the delivery, the Buyer must cover the costs of returning the goods at the Seller's request.
    • During the delivery of the goods, the Buyer must check the condition of the shipment and the goods together with the Seller or the person who delivered the shipment.
    • By using the online store, the Buyer confirms that he agrees with these purchase-sale terms and must comply with them.

    PRICES OF GOODS

    • The prices of goods in the online store are indicated in euros. Prices include VAT. After confirming the order, the delivery fee is added to the total amount of the goods if it applies to the selected shopping cart.

    AVAILABILITY OF GOODS

    • All goods sold in the online store are available, but in rare cases, when more customers order a product, the product may become unavailable. In this case, the Buyer will be immediately notified that the product is no longer available, and contracts for unavailable goods will not be concluded.
    • On the product page, unavailable sizes are displayed in a different colour than available sizes. Out-of-stock items cannot be added to the cart, but you can add them to your wishlist or contact care@flameolingerie.com to order your desired size/product individually.

    ORDER OF GOODS AND PAYMENT

    • The online store flameolingerie.com is only available to persons over 18 years old.
    • After visiting the online store, the Buyer chooses the goods he prefers and puts them in the shopping cart. After forming the shopping cart, the Buyer enters the personal data necessary to fulfil the order: his name, surname, the address where the goods will be delivered, telephone number and additional information that may be important for the delivery of the ordered goods. The Buyer confirms that he has familiarized himself with these terms and confirms the order.
    • The payments can be made using the online banking services of Swedbank, SEB, Luminor, Citadele and Šiauliai banks, and Visa / MasterCard payment cards. Settlements are possible in euro currency. Payments are processed using the MakeCommerce.lt payment platform.

    TERMS FOR USE OF GIFT CARDS

    • The virtual gift card of FlameO! can only be used in the flameolingerie.com online store.
    • If the value of the gift card is less than the total amount of the order, you will have to pay the balance using one of the other payment methods.
    • If you received multiple gift cards, you could enter each code in the dedicated section (discount/gift card code), which will be used to pay for your goods.
    • You can use the gift card to cover the entire order price or as a partial payment. If the value of the gift voucher exceeds the total amount of the order, the remaining balance will be used for the next time - you will need to enter the gift voucher code during your next online order.
    • Virtual Gift Cards of FlameO! cannot be exchanged, returned, or redeemed. The gift card cannot be used to purchase another gift card.
    • When returning an order paid by a gift card, the amount spent on the order from the Gift card will be returned to the same Gift card.
    • The gift voucher is valid for one year from the date of purchase.

    DELIVERY OF GOODS

    • Goods are delivered in European Union.
    • Goods are delivered through the Omniva, LP Express and DPD parcel service.
    • Delivery of goods is free when order is above 100 Eur and it is delivered to the selected Omniva, LP Express and DPD self-service parcel terminal.
    • The goods are delivered to the Buyer by an authorized representative (courier) or via the parcel terminal system.
    • When ordering goods, the Buyer must specify the accurate delivery address.
    • The Buyer must accept the goods himself. If the Buyer cannot receive the goods himself, but the goods are delivered to the address specified by the Buyer, the Buyer has no right to make claims regarding the delivered goods to the wrong person.
    • The Seller usually delivers the goods to the buyer within 3-7 business days in Lithuania and 5-10 business days in EU. The preliminary deadline does not apply if the necessary goods are not in stock or when the goods are ordered individually and the Buyer is informed about this.
    • The Buyer must, in all cases, immediately inform the Seller if the shipment is delivered in crushed or otherwise damaged packaging, contains unordered goods, the wrong quantity of items, or incomplete product assembly.
    • In all cases, if the Buyer notices any damage to the packaging during the delivery, he must indicate the comments in the package delivery document provided by the courier or write a separate paper regarding these violations. The Buyer must do this in the presence of the courier. If such actions are not taken, the Seller is released from responsibility towards the Buyer for product damage related to packaging damage, which the Buyer did not note in the courier's delivery document.
    • We ship orders from Monday to Friday, and non-business days are not included in the delivery time. Delivery time is calculated from the day when the shipment is confirmed.
    • The characteristics of all sold goods are indicated in the description attached to each item. The Seller is not responsible for the fact that the colour, shape, or other parameters of the goods in the online store may not correspond to the actual size, shape, and colour of the goods due to the characteristics of the monitor used by the Buyer.

    RETURN OF GOODS

    • The Seller ensures that all goods are new, of good quality and unused. Unless otherwise stated in the product description.
    • Quality goods can be returned within 14 calendar days from the day of their receipt. Defects of sold poor-quality goods are eliminated, and poor-quality goods are exchanged and returned following the provisions of the Civil Code of the Republic of Lithuania.
    • The returned product must be in the undamaged and original packaging (shipping box).
    • When returning goods, the following conditions must be observed:
    • The returned product must be in its original, neat packaging.
    • The Buyer must not damage the product.
    • The product must be unused without losing its commercial appearance: intact, untorn labels, untorn protective films, disposable seals, etc.
    • The returned product must be of the same set as the one received by the Buyer;
    • Upon the Seller's request, the Buyer must keep a document proving the purchase of the goods (e.g., VAT invoice);
    • The Seller has the right to refuse to accept the goods returned by the Buyer if the conditions for returning the goods were not met;
    • The return of goods is carried out as determined by the Seller within 14 (fourteen) calendar days of receiving the goods. For more information on how to return a product, read the section on the Return of goods.
    • Return and exchange of goods of suitable quality are carried out under Article 6.22810, Part 1 of the Civil Code of the Republic of Lithuania.
    • The money to pay for the goods accepted by the Buyer but later refused is returned to the Buyer's account within 14 (fourteen) calendar days from the day of returning the goods to the Seller.

    RETURN OF POOR-QUALITY GOODS

    • If the product is returned due to our fault or because it has been damaged or defective, the Seller arranges a courier to the Buyer's address to pick up the damaged or poor-quality goods.
    • Defective or damaged goods must be reported to the Seller within fourteen (14) days of receiving the order at care@flameoinfo.com. Goods must be returned in the same condition as they were delivered.
    • Returned goods must not be used, worn, washed or damaged; the identification label must still be attached to products with a disposable seal; the goods must be returned complete and unused, with the original packaging.
    • The Seller will check the returned goods and inform you as soon as possible that the goods have met the criteria of defective or damaged goods within five (5) business days. Usually, the money is returned to the Buyer within fourteen (14) days from the day the Seller confirms by e-mail that the Buyer has the right to a refund for a damaged or poor-quality product.
    • If the Seller determines that the goods are not damaged or defective, the Buyer is informed that the returned goods cannot be accepted and may be delivered to the Buyer again. If the Buyer does not agree to the re-delivery, the Seller reserves the right to keep the goods and the amount paid and recover the fees and expenses incurred by the Seller.

    NON-RETURNABLE GOODS

    The exchange and return of goods are governed by The Retail Trade Rules, approved by the Government of the Republic of Lithuania on 2014 July 22, by resolution no. 738. They also apply to remote purchase-sale agreements and contracts concluded off-premises. Clause 17 of these rules contains a list of goods that can be exchanged or returned only with the Seller's consent.

    Therefore, due to the intimate nature of our products, there are no returns for any products intended to encounter private areas.

    Once these products leave our warehouse, they are considered used and non-returnable. Returns are only accepted if the item is damaged or defective. Upon receipt of the goods, please inspect them immediately and inform us if you have received a damaged or defective product.

    Non-returnable products:

    • BAED STORIES underwear
    • Tights, clip stockings, socks
    • Panties
    • Mesh bodysuit
    • Latex products
    • The leather of the entire body or hip belts
    • Gift cards
    • Final sales products
    • Goods with traces of lipstick, deodorant, or make-up
    • Goods with perfume, tobacco, or body odour
    • Damaged, used goods without labels and protective seals.

    IDENTIFICATION LABELS

    All products the Seller sells have an identification label with a disposable seal. Try on the products without removing tags. Returns without labels with a disposable seal are not accepted.

    SALES

    Due to the high volume of orders during sales, orders can be shipped within 8 business days. 

    COPYRIGHT

    The content of this website, including photos, films, and texts, is protected by copyright and other rights. Images, films, and texts are for private use only, and any further use without the expression of written consent of the Seller is prohibited.

    FINAL PROVISIONS

    • These Terms are drawn up following the legal acts of the Republic of Lithuania.
    • These Terms and relations between the Parties relating to these Terms are applied and interpreted based on the laws of the Republic of Lithuania.
    • All disagreements arising from implementing these Terms shall be resolved through negotiations. If an agreement cannot be reached, disputes are determined by the procedure established by the laws of the Republic of Lithuania.
    • The Parties are released from fulfilling their obligations under these Terms if they cannot be fulfilled due to unforeseen circumstances beyond the control of the Parties (Force majeure).
